What to look for in a petitioner?
Appraise the petitioner thoroughly. Have a friend or relative living in USA visit the petitioner and his/her place of operation.
- Have they successfully petitioned any one before?
- Do they know immigration petition process or visa screen process?
- Who should you call if you have questions about your petition and how long will it take for an answer?
- Is the person recruiting for them (DON or another recruiter) properly authorized and what would happen if they are no longer affiliated?
- Who will pick you up at airport on arrival in USA?
- Where do you stay upon arrival and when will you start paying for your housing? And how much?
- Provision of the study material for NCLEX_RN examination preparation
- Is there food available or do you have to provide it yourself and how soon?
- How will you get your SSI# and state ID? Who will take you there?
- How will you locate permanent housing in an area you have never been to? And who will help you?
- Who will co-sign for you when you try to secure housing? What is the housing cost and how will you afford it?
- How do you get to work? Is there public transportation? And how far are you from public transportation?
- Who will help you set up your housing?
- What kind of medical insurance and how soon would you be covered? It takes 60 to 90 days before you are eligible to health care facility medical insurance.
- If you fall ill or meet with an accident before you are covered, who pays for the medical expenses?
- When would you be expected to start working? At what capacity (CNA or RN). At what salary?
- If you are expected to work as soon as you arrive, how do you prepare for NCLEX?
- Would the facility arrange or allow time for you to attend NCLEX review classes or are you expected to "self review"?
- Are you expected to work full time while reviewing for NCLEX?
- Are the review classes conveniently located and available?
- What happens if you fail NCLEX?
- Would they keep you as a CNA, at what salary, housing etc.?
- What happens if the health care facility is unhappy with you or you do not like the facility?
- What are your choices? Would they help you find another employer or leave it to you?

Do I have to work for my petitioner?
YES.
The EB-3 (Employment Based Visa) program is designed to help American Employers who are unable to find sufficient number of qualified American workers while offering prevailing wages and prevailing work conditions.
When an EB-3 visa holder refuses to work for the petitioner, it defeats the purpose of the program. Entering the USA on an EB-3 visa with no intention of working for the petitioner, though a bona fide job exists is a serious crime called VISA FRAUD. Expect INS to take steps to enforce the law in the next few months. Currently, the only time that INS enforces the law is:
- When the petitioner complains to INS.
- At the time the EB-3 visa holder applies for US citizenship. If records indicate that the individual never worked for the petitioning EB-3 employer, INS will deny the application for citizenship and deport the individual. After settling and establishing life in USA, the individual will be deported causing emotional and financial hardship.

How about my family? Can I bring them with me?
We apply for family immigration. We prefer that the employee travels alone and brings the family after completing NCLEX and settling into the job. This usually takes 3 to 6 months. Children under 21 years also get immigrant visas. Children who are married do not qualify. Both INS and the American Consulate have procedures for processing children who are in danger of aging out rapidly. The immigrant nurse or the spouse can petition for immigration visas for married children and children over the age of 21 after they obtain permanent residency. This takes many years due to Quota system for each country. Fortunately, under a new "V" visa program, these children may enter USA and work legally after the visa applications have been in process for three years.

To work as a registered nurse in the U.S. you must obtain a license to practice. To receive a license you must pass the NCLEX-RN examination, which is administered by the National Council of State Boards of Nursing. | What does the NCLEX-RN examination entail?
The NCLEX-RN is a multiple-choice examination taken on a computer focusing on your "critical thinking". All candidates are asked between 75 and 265 questions with the exact number of questions determined by the computer depending upon your previous answers. The maximum duration of the exam is five hours. The exam results are usually available within 72 hrs. in most states.

| What is a U.S. Permanent Residency Visa?
A permanent residency visa allows the holder to permanently reside and work in the U.S. This visa is more commonly referred to as a Green Card, which has been carried over from the days when the visa was green in color. Nurses are issued Employment based (EB 3) visa and are sponsored by the employer, who could not find American Employees.

SRS Medical finances all filing fees for the nurse's Green Card as well as handling the correspondence with U.S. Immigration and Naturalization Service (INS). Once the INS approves the application for sponsorship for a Green Card the nurse is requested to attend an interview at the local U.S. Embassy. All expenses connected with the Green Card interview, such as visa issuance fee and Medical exam fee, are covered by SRS Medical.

| What is Visa Screen and what are the requirements for certification?
Visa Screen is a screening program for healthcare professionals applying for occupational visas (such as a Green Card) to work in the U.S. It is one of the necessary steps in obtaining a U.S. visa. Applicants will be reviewed for their ability to meet standardized criteria in education, licensure, and English language proficiency. (Nurses who have graduated from a college, university or a professional training school located in Australia, Ireland, New Zealand, the United Kingdom and the United States are exempt from the English language requirement). Upon successful completion of the Visa Screen program applicants will receive a Visa Screen certificate which should be submitted to the U.S. Embassy or Consular Office as part of an application for an occupational visa (such as a Green Card).

SRS Medical pays the costs associated with the Visa Screen application. These are valued at U.S. $325. The TOEFL/TWE and TSE examinations cost $110 and $125 respectively or IELTS costs $110.

| How much time will pass before I travel to the U.S.?
SRS Medical has over 27 years of experience in placing healthcare professionals into U.S. assignments. It will take approximately 10 to 12 months from the time you are accepted into SRS Medical sponsorship program and we apply for your Green Card. During this time you will complete TOEFL/TWE. TSE or IELTS and obtain Visa Screen Certificate. We don't initiate the 2nd part of the visa process (pocket 3- Criminal and family background) until you complete your TSE or IELTS. Please note that your nursing exam and license are governed by the U.S. Board of Nursing and your visa is processed by the U.S. Immigration and Naturalization Service (INS). The timing of each event is not in the control of SRS Medical and therefore we cannot significantly alter this waiting period. SRS Medical will be completing the required documents and submitting them in a timely fashion.

Do I need to clear CGFNS/ NCLEX_RN / TOEFL/ TWE/ TSE before going to USA?
Yes, it is mandatory to have cleared the above-mentioned exams.
- However, not all of the 50 states in the U.S.A. REQUIRE CGFNS to be cleared. The following states require that foreign nurses pass the CGFNS examination before taking the state RN licensing (NCLEX) examination: Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, North California, South Dakota, Texas, Vermont, Virginia, Washington, West Virginia and Wyoming. The current vacancies are in New York and California where the CGFNS is not required.
- NCLEX- RN examination must be appeared for and passed in the United States to allow you to work legally as a nurse in America.
- Written and spoken English skills are mandatory. You have to pass the Test of English as a Foreign Language (TOFEL), which includes the Test of Written English (TWE).

As mentioned earlier, candidates do not have to pay for any of the expenses. In fact wherever possible we try and get our clients to sponsor your examination fees etc. However, there are certain charges such as visa processing, certain medical testing etc. which are to be borne by the individual candidates. For certain very expensive study material which costs upwards of Rs. 30,000 to 40,000 etc we do keep a nominal refundable deposit to ensure safekeeping of the material when we hand it over to you. And you don't even have to pay the traveling charges. SRS makes arrangements for the same.
